San Bernardino County Superior Court Judge Donald Alvarez told attorneys that he has seen enough evidence to include White in a preliminary injunction against the gang, but put off his final ruling until Dec. 4.
40 Glocc, has filmed videos at the apartment complex and visited family and friends there.
In one video posted on YouTube, friends of 40 Glocc greet him by flashing handguns and children inquire about buying drugs. In others, he curses the officers and prosecutors who put together the injunction, holds weapons and displays hand signs.
40 Glocc's attorney, Thomas Brackey II, told the judge that his client "vehemently denies being a member of the Colton City Crips."
The music and videos are just entertainment,40 Glocc said.
He is the only person so far to contest being included in an injunction issued in September against 60 suspected members of the gang.
The judge told Lead Deputy District Attorney Mark Vos and 40 Glocc's attorney to meet and work out the final wording of the injunction to make sure it does not violate White's free speech rights.
Brackey said by phone afterward that he believes the judge was not comfortable enough with the First Amendment issue to make a final ruling.
"There is no way it passes constitutional muster for a judge to say if you're outside the physical safety zone (the Arbor Terrace Apartments and a nearby liquor store) that you're not allowed to talk about gangs any more," Brackey said.
He said restrictions written into the injunction are "very, very vague" and could be interpreted to prevent White from reading aloud from a newspaper story about crime at the apartment complex.
